Child Support "Pro Se" Forms
by: Iowa Legal Aid
Do you need to change the amount of child support you are paying or getting? You can do this without a lawyer. In June 2008, the Iowa Supreme Court issued forms for changing child support.
You do not need to have an attorney to use these forms. The forms include instructions.
You can download the forms from the Iowa Judicial Branch website free of charge. You can go to the www.iowacourts.gov website. A shortcut to the page with the forms is http://www.iowalegalaid.org/link.cfm?2414 You can also get the forms in packets from the District Court Clerk. The cost for each packet is $10.
For What Can the New Forms Be Used?
You can use these forms to ask the court to:
- Change the amount of child support you pay;
- Change the amount of child support you get;
- Stop the child support; or
- Change who gets to claim the tax deduction and how medical expenses are paid for the children.
You cannot use these forms to change a court order about physical care, custody or visitation. If you have the children, but the order gives physical care or custody to the other parent, you cannot use the forms. You will still need an attorney to help you change custody and support at the same time. Iowa now has forms for people to use without a lawyer in two situations. Iowa has forms for people to file for divorce when they have no minor children.
Iowa also has forms people can use to change child support. In the future, there will be more forms for people to use so that they can file court cases without a lawyer. There will be forms for a divorce without a lawyer for people with children. These forms will not be available for a while. You can check the iowalegalaid.org website or www.iowacourts.gov website to see what forms are ready.
